Terms of Service — Scorella

These Terms of Service ("Terms") are a legal agreement between you and Scorella, operated by Ahmed Tolbh ("we", "us"). By creating an account or using the App you agree to these Terms.
1. The service
Scorella is a mobile application for sharing short educational videos and following creators. The service includes account creation, video upload and playback, comments, likes, follows, direct messages, push notifications, and related features.
2. Eligibility
You may use Scorella only if:
- You are at least 13 years old (16 in some EU jurisdictions).
- You have the legal capacity to enter into a binding agreement.
- You are not barred from using the service under applicable law.
- You are not currently suspended or banned by us.
If you are under the age of majority where you live, your parent or guardian must agree to these Terms on your behalf.
3. Your account
- You must provide accurate information during signup.
- You are responsible for keeping your password and device secure. Notify
us immediately at [email protected] if you suspect unauthorized access.
- One account per person. We may suspend duplicate or impersonation
accounts.
- You can delete your account at any time from Settings → Delete account.
4. Your content
4.1 Ownership
You retain ownership of the videos, images, text, and other content you create or upload ("User Content"). You do not transfer copyright to us.
4.2 License you grant us
By submitting User Content, you grant Scorella a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transcode, distribute, display, and perform that content solely for the purpose of operating and providing the service to you and other users. This license ends when you delete the content or your account, except where the content has been re-shared by other users (their copies remain until they delete them).
4.3 Your responsibilities
You promise that:
- You own the User Content or have all the rights necessary to grant us
the license above.
- The User Content does not violate anyone else's copyright, trademark,
privacy, or other rights.
- The User Content does not violate the rules in §5.
You are solely responsible for your User Content. We are not the author or publisher.
5. Prohibited content & conduct
You may not upload or post anything that:
- Is sexually explicit, exploits minors, or sexualizes children in any way.
- Depicts gratuitous violence, gore, or animal cruelty.
- Promotes weapons, illegal drugs, or self-harm.
- Is hateful, harassing, or discriminatory toward a person or group based
on race, religion, gender, sexual orientation, disability, or similar protected characteristic.
- Infringes copyright, trademark, or other intellectual-property rights.
- Is misleading, deceptive, or impersonates another person.
- Contains malware, phishing links, spam, or scams.
- Encourages illegal activity.
You may not:
- Use the service to harass, threaten, or bully other users.
- Reverse-engineer, scrape, or interfere with the service.
- Bypass rate limits, content filters, or security measures.
- Use bots or automation to inflate views, follows, or engagement.
- Resell or sublicense access to the service.
We use automated content moderation (Sightengine) on every uploaded video. Videos that fail moderation are deleted and do not reach the public feed. Repeated violations may lead to account suspension or permanent ban without refund.
6. Reporting & moderation
If you see content or conduct that violates §5, please report it via the in-app report feature or by emailing [email protected]. We review reports and take action at our discretion, including but not limited to removing content, warning users, suspending accounts, and banning accounts. We do not pre-screen all content.
For copyright infringement (DMCA), contact us with: 1. Identification of the copyrighted work. 2. The location of the infringing material in the App. 3. Your contact information. 4. A statement that you have a good-faith belief the use is unauthorized. 5. A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner.
7. Push notifications & email
We may send you push notifications (likes, follows, comments, mentions, moderation outcomes) and transactional email (password reset, email verification, important account messages). You can opt out of push notifications from Settings → Notifications or in your device settings; transactional email cannot be turned off as long as you have an active account.
8. Service availability
We do our best to keep the service available 24/7, but we make no uptime guarantee. We may suspend or change features, run maintenance, or discontinue the service with reasonable notice.
9. Termination
You may terminate your account at any time. We may suspend or terminate your access immediately, without notice, if:
- We believe you have violated these Terms.
- We are required to do so by law.
- The service is being discontinued.
On termination, the licenses you grant under §4.2 end and your User Content is deleted (subject to §7 of the Privacy Policy regarding backups).
10. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, error-free, or secure. To the maximum extent permitted by law, we disclaim all such warranties.
11. Limitation of liability
To the maximum extent permitted by applicable law, in no event will Scorella, its operator, or its sub-processors be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the service.
Our total aggregate liability for direct damages shall not exceed USD $100 or the amount you paid us in the past 12 months, whichever is greater.
Some jurisdictions do not allow these limitations; in those cases the limits apply only to the extent permitted.
12. Indemnity
You agree to indemnify and hold harmless Scorella, its operator, and its sub-processors from any claim, damage, or expense (including reasonable legal fees) arising out of:
- Your User Content.
- Your violation of these Terms.
- Your violation of any third-party right.
13. Governing law & disputes
These Terms are governed by the laws of [JURISDICTION TO BE DETERMINED BY LEGAL COUNSEL]. Any dispute will be resolved exclusively in the courts of that jurisdiction, except where mandatory consumer protection laws give you the right to bring an action in your country of residence.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
